Terms of Service
Last Updated: [2/24/2026]
These Terms of Service (“Terms”) govern your access to and use of the website located at
[https://www.arsaccounting.com] (the “Site”), which is owned and operated by
ARS Accounting (“ARS,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1) Who We Are and What These Terms Cover
The Site provides general information about ARS, our services, educational content, and ways to contact us or request a consultation. These Terms apply to all visitors, users, and others who access the Site (“you”).
These Terms apply only to your use of the Site. Separate terms may apply to professional services provided by ARS under an engagement letter, service agreement, or other written contract (“Engagement Agreement”).
2) No Professional Relationship Created by Website Use
Your use of the Site—including submitting a contact form, emailing us, scheduling a consultation, or chatting with us—does not create a CPA-client, accountant-client, tax preparer-client, or fiduciary relationship.
A professional relationship with ARS is created only when:
- ARS confirms acceptance of you as a client, and
- you and ARS sign an Engagement Agreement (and, if applicable, provide any required deposit/retainer).
3) No Tax, Accounting, Legal, or Investment Advice on the Site
The Site may include general information related to accounting, tax, payroll, business operations, and financial topics. This content is provided for general informational purposes only and is not professional advice.
- Do not act—or refrain from acting—based on Site content without seeking professional advice tailored to your situation.
- Tax laws and interpretations change frequently and may vary based on facts and jurisdictions.
If you want advice for your situation, request an engagement with ARS.
4) Eligibility and Use of the Site
You agree that you will:
- use the Site only for lawful purposes;
- not interfere with or disrupt the Site, servers, or networks;
- not attempt to gain unauthorized access to any portion of the Site;
- not upload or transmit malware, spyware, or harmful code;
- not use automated scraping, spiders, or data-mining tools without our written consent.
We may restrict or terminate access to the Site at any time, with or without notice, for any reason, including suspected misuse.
5) Communications, Contact Forms, and No Confidentiality Guarantee
If you submit information through the Site (forms, email links, scheduling tools, chat widgets, etc.), you understand:
- Do not submit sensitive confidential information (e.g., Social Security numbers, bank account numbers, full tax returns, passwords, or highly sensitive personal data) unless we have explicitly provided a secure method for doing so.
- While we take reasonable steps to protect information, internet transmissions are not 100% secure. We cannot guarantee that communications sent through the Site are confidential or secure.
- Communications through the Site do not create a professional relationship as described above.
6) Scheduling, Consultations, and Service Requests
The Site may allow you to request a consultation or schedule an appointment. Any appointment request is subject to:
- availability,
- confirmation by ARS,
- and, if applicable, completion of intake steps.
We may require additional information before confirming an appointment or accepting any engagement.
7) Client Services and Engagement Terms Control
If you become a client, the terms in your Engagement Agreement control topics such as:
- scope of services,
- fees and billing,
- responsibilities and deadlines,
- document retention,
- dispute resolution,
- limitations of liability (if any),
- and termination.
If there is a conflict between these Terms and the Engagement Agreement regarding professional services, the Engagement Agreement controls.
8) Payments and Third-Party Service Providers
The Site may reference or integrate third-party tools (e.g., scheduling services, payment processors, document portals). Any third-party services are provided under their own terms and privacy policies.
We are not responsible for third-party platforms’ acts, omissions, security, or availability.
9) Intellectual Property and License
The Site and all content on it—including text, graphics, logos, images, videos, downloads, templates, and layout—are owned by ARS or licensed to ARS and are protected by intellectual property laws.
You may view and print pages for your personal, non-commercial use. You may not:
- copy, reproduce, distribute, modify, create derivative works, or publicly display Site content;
- use our trademarks, logos, or branding without prior written consent.
10) User Submissions
If you submit or upload content (where permitted), you represent that:
- you own it or have the right to submit it, and
- it does not violate any law or third-party rights.
You grant ARS a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your submissions solely for purposes of responding to you, operating the Site, and providing requested information/services.
11) Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the fullest extent permitted by law, ARS disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
We do not warrant that:
- the Site will be uninterrupted, error-free, or secure,
- the Site content will be complete, accurate, or current,
- defects will be corrected.
12) Limitation of Liability
To the fullest extent permitted by law, ARS and its owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Site.
To the fullest extent permitted by law, ARS’s total liability for any claim relating to the Site will not exceed $100.
Some states do not allow certain limitations of liability, so some of the above may not apply to you.
13) Indemnification
You agree to defend, indemnify, and hold harmless ARS and its owners, employees, contractors, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:
- your use of the Site,
- your violation of these Terms,
- your violation of any law or third-party rights.
14) Third-Party Links
The Site may contain links to third-party websites. These links are provided for convenience only. ARS does not control or endorse third-party sites and is not responsible for their content, policies, or practices.
15) Privacy
Your use of the Site is also subject to our Privacy Policy. Please review it to understand how we collect, use, and protect information.
16) Electronic Communications and Signatures
By using the Site and communicating with us electronically, you consent to receive communications electronically (e.g., email, portal messages). You agree that electronic notices, disclosures, and communications satisfy any legal requirement that such communications be in writing.
17) Termination
We may suspend or terminate your access to the Site at any time for any reason, including if we believe you have violated these Terms.
Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).
18) Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in [Broward County, Florida], and you consent to personal jurisdiction there.
